The Respondent failed to present a valid response on time. The Employment Judge has decided that a determination can  properly be made of the claim in accordance with rule 21 of the Rules of Procedure.

It was held that the Claimant was dismissed by reason of redundancy and is entitled to a redundancy payment.

The Employment Tribunal held that the Claimant’s claim under the Equality Act 2010 for the protected characteristic of disability, in particular claims of the failure to make reasonable adjustments and victimisation, are well founded against all four Respondents.

Employment Tribunal Decision 14 June 2023

The Claimant was a worker within the meaning of section 230 Employment Rights Act 1996. The Respondent made unauthorised deductions from wages by failing to pay the Claimant the full amount of wages due for work done between 30 August 2022 and 15 September 2022 and was ordered to pay the Claimant the sum of £2,830 being the total gross sum deducted.

The Respondent was also ordered to pay the Claimant additional compensation of £2,284 representing 4 weeks’ pay pursuant to section 38 Employment Act 2002.
